Terms of Service

1. Acceptance and Scope

These Terms of Service govern access to and use of the FINBL platform, operated by FINBL LLC, located at 7901 4TH ST N SUITE 300, ST PETERSBURG, FL 33702, United States. By creating an account or using FINBL, you declare that you have read, understood and accept these Terms, our Privacy Policy and our Cookie Policy, and that you meet the age and legal capacity requirements. If you do not agree, you must not use the Service.

2. Service Description

FINBL is a personal financial management platform that offers:

• Banking aggregation via Open Banking (PSD2) to view accounts, balances and transactions in read-only mode.
• Financial analysis with automatic transaction categorization, reports and trend tracking.
• AI assistant that answers financial queries, analyzes documents and provides personalized insights.
• Goal and debt management: tools for savings targets, spending limits and debt tracking.
• Document management: upload, storage and automated analysis of financial documents.
• Multi-currency support: management across 40+ currencies.
• Organization spaces: collaborative financial management with role-based access control.

3. Account Requirements

To use FINBL, you must create an account. By doing so, you agree to:

• Be at least 16 years old. If you are under 18, you declare that you have the consent of your parent or legal guardian.
• Provide accurate, truthful, up-to-date and complete information, and keep it updated.
• Maintain the confidentiality of your password and access credentials.
• Be responsible for all activity that occurs under your account.
• Maintain a single personal account. Organization accounts may have multiple members.

4. Plans and Subscriptions

FINBL offers different subscription plans with varying levels of functionality. Details for each plan (pricing, features, limits) are shown on the Platform's pricing page. You can change your plan at any time; changes take effect in the next billing period.

5. Payments and Billing

Payments are processed securely through Stripe (PCI-DSS certified). FINBL does not store credit or debit card data.

• Billing is recurring (monthly or annual). Charges are processed automatically on the renewal date.
• Prices are stated in euros (EUR) and include applicable taxes.
• No partial refunds are issued for unused periods, unless required by law.
• In case of non-payment, FINBL may suspend access to paid features.

6. Acceptable Use

You agree to use FINBL responsibly and lawfully:

• Use the service only for lawful purposes and in accordance with these Terms.
• Not attempt to access other users' accounts, data or systems.
• Not reverse engineer, decompile or disassemble the software.
• Not use the service for fraudulent activities or money laundering.
• Not transmit viruses, malware or malicious code.
• Not overload, damage or disable our systems.
• Not use unauthorized bots, scrapers or automated systems.
• Not infringe intellectual property rights.

7. Open Banking (PSD2)

FINBL facilitates connection with your banks via Open Banking under the PSD2 Directive, through our regulated provider Enable Banking Oy (registered AISP).

• Access is exclusively read-only. FINBL cannot make transactions or modify your accounts.
• Each connection requires your explicit authorization from your bank. Consents have a maximum validity of 90 days.
• You can revoke any connection at any time from FINBL or with your bank.

FINBL is not responsible for the availability or accuracy of data provided by bank APIs, nor for interruptions in the Open Banking service.

8. Artificial Intelligence Assistant

FINBL's AI assistant uses language models to provide personalized financial analysis and information.

FINBL is NOT a financial, investment, tax or legal advisor. Information provided is for informational purposes only, does not replace professional advice and may contain inaccuracies. Financial decisions are solely your responsibility.

9. Intellectual Property

All content, design, source code, trademarks, logos and software of FINBL are the exclusive property of FINBL LLC or its licensors. FINBL grants you a personal, non-exclusive, non-transferable and revocable license to use the Platform. You retain ownership of your data and documents; by using the Service you grant us a limited license to process them exclusively for the purpose of providing the Service.

10. Disclaimer

FINBL provides financial information for informational purposes only. We are not a regulated financial institution or registered financial advisor. The Service is provided «as is» and «as available». FINBL does not guarantee uninterrupted availability, accuracy of information or that the service will be error-free.

11. Limitation of Liability

To the maximum extent permitted by law, FINBL shall not be liable for indirect, incidental, special, consequential or punitive damages. Total aggregate liability shall not exceed the amount paid by the user in the preceding 12 months. FINBL shall not be liable for financial decisions made based on information from the Platform. Nothing in these Terms limits our liability where the law does not permit it.

12. Termination and Cancellation

You can cancel your account at any time from settings. After cancellation, your subscription will continue until the end of the current period and your data will be retained in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if you breach these Terms, use the service for illegal activities, your account remains inactive for more than 24 months, or as required by a competent authority. We will notify you at least 15 days in advance, except in cases of legal urgency.

13. Changes to the Terms

We may modify these Terms periodically. We will notify you by email at least 30 days in advance and post a notice on the Platform. If you do not agree, you may cancel your account before they take effect.

14. Governing Law and Jurisdiction

For EEA users: these Terms are interpreted in accordance with the laws of your country of residence. Any dispute shall be submitted to the competent courts of your habitual place of residence. You may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

For non-EEA users: these Terms are governed by the laws of the State of Florida, United States. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), based in St. Petersburg, Florida.

If any provision is found invalid, the remaining provisions shall remain in full force. Failure to enforce any provision shall not constitute a waiver of future enforcement.
